A recent legislative change in Brazil is set to streamline the process of child support payments. The newly enacted Law No. 15.479/2026 modifies the Civil Procedure Code (CPC) to allow for automatic monthly transfers of child support directly from the debtor's bank account to the beneficiary's account. This digital mechanism aims to reduce bureaucratic hurdles and provide greater predictability for families relying on these resources. The new rule will take effect on July 30, 2027, giving the public and financial systems a year to adapt. Until then, traditional judicial procedures will remain in place. ## How the New System Will Work Under the updated law, individuals entitled to child support can request the court to include automated payments at any stage of the legal process. Once approved, the judge will notify the bank through an integrated electronic system. The judicial order will specify: - Full identification of the creditor and debtor - The exact monthly amount to be deducted and the payment period - Details of the debit and credit accounts - Adjustment criteria, correction indices, and applicable interest rates This system ensures a more efficient and transparent process for both parties involved. ## Immediate Account Blocking for Non-Payment To prevent delays and defaults in child support payments, the law imposes strict penalties if the debtor's account lacks sufficient funds on the scheduled payment date. In such cases, the financial institution will report the issue to the supervisory body, which may automatically block other financial assets of the debtor up to the overdue amount. If legal requirements are met, the blocked amount will be seized and transferred to the beneficiary. ## Impact on Businesses Despite the introduction of this banking innovation, the traditional payroll deduction method for child support payments remains unchanged. Therefore, the rules operate in two distinct ways: - **Payroll Deduction (Labor)**: When a judge orders a direct deduction from an employee's salary, the company's HR department will continue to be responsible for the retention and transfer. - **Automatic Bank Transfer (Civil)**: Applies to judicial orders directed to the bank where the debtor holds an account or assets. This alteration aims to provide a modern, digital alternative for compliance with judicial decisions without altering the Consolidation of Labor Laws (CLT). The law has already been approved and published in the Official Gazette, with a transition period for adaptation.
